1. Agreement to Terms
By accessing or using Super ("Service"), provided by Atomico Labs S.L. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
Super is an AI-first business operating system that provides integrated tools for project management, CRM, content management, team communication, analytics, and business operations. The Service includes web applications, mobile applications, APIs, and related services.
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party and to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3.3 Account Types
We offer different account types (Agent, Manager, Executive, Enterprise) with varying features and capabilities. The specific features available to you depend on your subscription plan.
4. Subscription and Payment
4.1 Pricing
Subscription fees are charged in advance on a monthly or annual basis. Prices are subject to change with 30 days' notice. Current pricing is available at super-ware.com/pricing.
4.2 Free Trial
We may offer a free trial period. At the end of the trial, your account will be converted to a paid subscription unless you cancel before the trial ends.
4.3 Refunds
Annual subscriptions may be eligible for a pro-rata refund within 14 days of purchase. Monthly subscriptions are non-refundable. Contact support@super-ware.com for refund requests.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the integrity of the Service
- Collect or harvest user data without consent
- Use the Service for any illegal or unauthorized purpose
- Resell or redistribute the Service without authorization
6. Intellectual Property
6.1 Our Rights
The Service and its original content, features, and functionality are owned by Atomico Labs S.L. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Your Rights
You retain all rights to your data and content uploaded to the Service. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.
7. Data Ownership and Portability
Your data belongs to you. You may export your data at any time using our export tools. Upon account termination, we will retain your data for 30 days to allow for export, after which it will be permanently deleted unless legally required to retain it.
8. AI Features
The Service includes AI-powered features. While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing and verifying AI-generated content before use. We do not use your data to train general AI models without explicit consent.
9. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.
10. Limitation of Liability
To the maximum extent permitted by law, Atomico Labs S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
11. Indemnification
You agree to indemnify and hold harmless Atomico Labs S.L. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of Spain, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Barcelona, Spain.

Data Processing Agreement

1. Scope
This Data Processing Agreement ("DPA") forms part of the Terms of Service between you ("Controller") and Atomico Labs S.L. ("Processor") for the processing of personal data.
2. Definitions
Terms used in this DPA have the meanings given in the GDPR and applicable data protection laws.
3. Processing Details
- Subject Matter: Provision of the Super platform
- Duration: Term of the subscription agreement
- Nature and Purpose: Storage, processing, and display of business data
- Data Categories: Contact information, business data, usage data
- Data Subjects: Customer employees, customer's customers and contacts
4. Processor Obligations
The Processor shall:
- Process data only on documented instructions from the Controller
- Ensure personnel are bound by confidentiality obligations
- Implement appropriate technical and organizational security measures
- Assist the Controller in responding to data subject requests
- Delete or return all personal data upon termination
- Make available information necessary to demonstrate compliance
5. Sub-Processors
A list of approved sub-processors is available at super-ware.com/subprocessors. We will notify you of changes with 30 days' notice.
6. Security Measures
We maintain comprehensive security measures as described in our Security Whitepaper, available upon request.
7. Data Breach Notification
We will notify you of any personal data breach without undue delay and within 72 hours of becoming aware of the breach.
8. International Transfers
Data transfers outside the EEA are governed by Standard Contractual Clauses incorporated by reference into this DPA.
